1. Introduction and Acceptance of Terms
These Terms and Conditions ("Terms") govern access to and use of the website located at theevolvefoundation.com ("Website") and the educational programmes for real world readiness and related services ("Services") offered by The Evolve Foundation, having its registered office at 94A, Karpagam Ave, RA Puram, Chennai 600028, Tamil Nadu, India.
By accessing the Website, registering for a Programme, or making payment for any Service, the person doing so ("User," "you," or "Student") agrees to be bound by these Terms, the Privacy Policy, and any Programme-specific terms communicated at the time of enrolment. If you do not agree to these Terms, you must not use the Website or enrol in any Service.
These Terms constitute a legally binding agreement between you and The Evolve Foundation. It is recommended that you read them carefully, in full, before enrolling.
Supplemental terms and conditions or Programme-specific documents may be communicated or posted from time to time and shall form part of these Terms where applicable. The Evolve Foundation reserves the right to make changes or modifications to these Terms. Material changes affecting enrolled Students will be communicated as set out in Clause 12.
The information provided on the Website is not intended for distribution to or use by any person or entity in any jurisdiction where such distribution or use would be contrary to law or regulation. Persons who access the Website from other locations are responsible for compliance with applicable local laws.
2. Eligibility and Age Requirements
2.1 The Services are primarily intended for young people and college students within the age range specified for each Programme. Launchpad is intended for college students between the ages of 17 and 24 (inclusive).
2.2 For Users who are 17 years of age, the following additional conditions apply:
- Enrolment and payment must be made by, or with the express and verifiable consent of, a parent or legal guardian ("Guardian"), who shall confirm acceptance of these Terms on the minor Student's behalf.
- The Guardian shall be treated as a party to this agreement jointly with the minor Student for the purposes of payment obligations, refund requests, and communications regarding the Services.
- Any consent required for the collection, use or processing of the minor Student's personal data under Clause 5 must be given or verified by the Guardian.
2.3 Users aged 18 and above who enrol in their own capacity confirm, by accepting these Terms, that they are of legal age to contract in their jurisdiction and have the capacity to enter into a binding agreement.
2.4 The Evolve Foundation reserves the right to request proof of age or student status where relevant to a Programme and to refuse or cancel enrolment where eligibility criteria are not met.
3. Description of Services
3.1 The Evolve Foundation offers educational and developmental programmes designed to help young people prepare for the real world. Programmes may include areas such as self-understanding, strengths, direction, decision-making, confidence, communication, execution, life capabilities, mentoring and other areas relevant to real world readiness.
3.2 Programme content, facilitators or mentors, schedule, mode of delivery, duration and specific outcomes are as described on the Website or in Programme-specific materials at the time of enrolment. The Evolve Foundation may make reasonable updates to Programme content or delivery. Material changes to an enrolled Student's Programme will be communicated in advance where reasonably possible.
3.3 The Evolve Foundation does not guarantee any specific employment, academic, career or personal outcome as a result of completing a Programme.
4. Fees, Payment, and Enrolment
4.1 Programme fees are as displayed on the Website or otherwise communicated at the time of enrolment, inclusive or exclusive of applicable taxes as indicated. Fees must be paid in full before access to the Programme is granted, unless The Evolve Foundation has expressly agreed otherwise in writing.
4.2 Payments may be processed through Razorpay or another payment processor communicated by The Evolve Foundation. The Evolve Foundation does not store full payment card details; payment data is handled in accordance with the security standards and privacy practices of the relevant payment processor.
4.3 Enrolment is confirmed only upon receipt of payment and issuance of a confirmation by The Evolve Foundation.
4.4 The Evolve Foundation reserves the right to revise Programme fees for future enrolments at any time. Fee revisions will not affect Students already enrolled and paid for a given Programme batch.
5. Consent for Use of Personal Data
5.1 By registering on the Website or enrolling in a Programme, you acknowledge that The Evolve Foundation will collect and process personal data as described in its Privacy Policy, including information such as name, age, contact details, college or institution details, payment-related information and Programme participation records, for purposes including:
- processing enquiries, enrolment and payment;
- delivering and administering the Programme, including attendance and participation tracking;
- communicating with you regarding the Programme, schedule changes and related administrative matters;
- improving the Services, including anonymised or aggregated analysis of Programme effectiveness;
- sending promotional or marketing communications where you have opted in or where otherwise permitted by law, and from which you may opt out; and
- complying with applicable legal and regulatory requirements.
5.2 Where the Student is under 18 years of age, any consent required under applicable law must be provided or verified by the Student's Guardian in accordance with Clause 2.2, in addition to any assent obtained from the Student where appropriate.
5.3 The Evolve Foundation shall not sell personal data to third parties. Personal data may be shared with service providers only as reasonably necessary for the purposes described above, such as payment processors, IT or hosting providers, online form providers, email or communication platforms, and video-conferencing providers, subject to applicable law.
5.4 Full details of data collection, use, retention and applicable rights, including access, correction and deletion requests, are set out in The Evolve Foundation's separate Privacy Policy, which forms part of these Terms by reference.
5.5 You (and, where applicable, your Guardian) may withdraw consent for non-essential processing, such as marketing communications, at any time by writing to enquire@theevolvefoundation.com. Withdrawal of consent for data essential to delivering the Programme may affect The Evolve Foundation's ability to continue providing the Service.
6. Cancellation and Refund Policy
6.1 The Evolve Foundation wants Students to have the opportunity to experience a Programme and determine whether it is right for them. Programme-specific refund terms may be communicated at the time of enrolment and, where applicable, shall form part of these Terms.
6.2 For Launchpad, a Student may attend the first two weeks and experience the Programme. If, after attending the first two weeks, the Student genuinely feels that Launchpad is not right for them, the Student may notify The Evolve Foundation in writing within 3 calendar days following completion of the second scheduled Programme session, and The Evolve Foundation will refund the Programme fee in full.
6.3 A Student who completes Launchpad with full participation and genuinely feels that the Programme has not helped them build greater clarity, confidence and a direction worth testing may speak with The Evolve Foundation. The Evolve Foundation will listen to and review the circumstances in good faith and seek to make the matter right, including offering a refund where The Evolve Foundation considers that to be the fair outcome.
6.4 Refund requests must be submitted in writing to enquire@theevolvefoundation.com and should include sufficient information to identify the relevant enrolment and the reason for the request.
6.5 Approved refunds will be processed to the original mode of payment within 8 business days of approval, subject to processing timelines of the relevant bank or payment gateway, which are outside The Evolve Foundation's control.
6.6 For Programmes other than Launchpad, the cancellation and refund terms communicated for that Programme at the time of enrolment shall apply.
7. Student Conduct and Responsibilities
7.1 Students agree to provide accurate and complete information at the time of registration, including proof of eligibility or enrolment in a college or university where required.
7.2 Students agree to participate in the Programme in good faith, including attending scheduled sessions and completing assigned exercises. Students acknowledge that developmental outcomes depend substantially on individual participation, reflection, practice and application.
7.3 Students shall not record, reproduce, distribute, publish, share or resell Programme content, materials or recordings without The Evolve Foundation's prior written consent.
7.4 Students are expected to engage respectfully with facilitators, mentors and other participants. The Evolve Foundation reserves the right to remove a Student from a Programme, without refund, in cases of serious misconduct, harassment, disruption, misuse of Programme materials or other material breach of these Terms.
8. Disclaimer of Outcomes and Limitation of Liability
8.1 The Evolve Foundation provides Programme content, structure and guidance in good faith and using reasonable professional effort. The benefit a Student derives from a Programme depends substantially on the Student's own participation, reflection, practice and application of the concepts and exercises.
8.2 Except for the refund commitments expressly set out in Clause 6, The Evolve Foundation makes no warranty or guarantee that any Student will achieve a particular result, including any specific career, employment, academic or personal outcome, as a result of taking a Programme.
8.3 To the maximum extent permitted by applicable law, The Evolve Foundation shall not be liable for any indirect or consequential loss or damage arising from a Student's failure to apply or benefit from Programme content where the Services have otherwise been delivered substantially as described.
8.4 Nothing in this Clause excludes or limits The Evolve Foundation's liability for fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
8.5 Subject to Clause 8.4 and applicable law, The Evolve Foundation's total aggregate liability arising out of or in connection with these Terms or the Services shall not exceed the amount of fees actually paid by the Student for the specific Programme giving rise to the claim.
9. Intellectual Property
9.1 All Programme materials, content, trademarks, logos and other intellectual property made available through the Website or a Programme remain the property of The Evolve Foundation or its licensors. Students are granted a limited, non-exclusive, non-transferable licence to use such materials solely for their personal learning purposes, subject to Clause 7.3.
9.2 The Evolve Foundation has taken reasonable care not to infringe third-party intellectual property rights in delivering its Programmes.
10. Term and Termination
10.1 These Terms shall remain in force while you use the Website or participate in a Service. The Evolve Foundation may suspend or terminate access to a Programme or the Website where a User materially breaches these Terms, engages in serious misconduct, misuses Programme content, or where suspension or termination is reasonably necessary to comply with law or protect The Evolve Foundation, its Students or its service providers.
10.2 Where The Evolve Foundation removes a Student from a Programme for serious misconduct or material breach under Clause 7.4, the Student shall not be entitled to a refund except where required by applicable law.
10.3 The Evolve Foundation reserves the right to take appropriate action in respect of misuse of its Website, Services, intellectual property or other rights.
11. Dispute Resolution and Governing Law
11.1 These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
11.2 Any dispute arising out of or in connection with these Terms shall first be addressed through good-faith negotiation between the parties. If unresolved within 30 days, the dispute shall be referred to a sole arbitrator in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Chennai, India.
12. Modification of Terms
12.1 The Evolve Foundation reserves the right to amend these Terms from time to time. Material changes affecting enrolled Students will be notified via email or Website notice where reasonably appropriate. Changes will apply prospectively from the date specified in the revised Terms, except where a change is required by law.
